A rectification deed /reconstitution deed may be made and accordingly a stamp duty can be paid on the remaining amt. and you can get through the situation. Even a supplementary agreement be pursued. Thanks & RegardsAsha BhutaArbitrator/MediatorMumbai
Q: Refund for cancellations after 60 days under Maha Rera registered proj
Refund for cancellations after 60 days under Maha Rera registered project. I tried to cancel bookings before 60 days but due to covid situation sales team didnt support me for cancellations. Can I use force marjeur as buyer? Is there any possibility that buyer can get refund? Due to uncertain situation I need to take this decision as its not easy to buy home and the again resale immediately.
Advocate Asha Bhuta answered
Yes you definitely can take the advantage of COVID lockdown and immediately write a letter to them consisting of all the facts so as to have a correspondence on record for future proceedings. If they are adamant then Unfortunately you would have to take a legal recourse against them.
Q: FD of intestate deceased as part of the estate
My mother kept her cash in FDs. I was joint owner of Fixed Deposits with my mother. After she died I replaced my mother's name with my brother's name on the account, because the bank suggested that the rate will be same if kept till maturity. After FD's maturity my brother cashed all the FDs without telling me. I have some more siblings. Can this money be recovered as part of my mother's estate.
Advocate Asha Bhuta answered
You must have removed your mothers name form the account right ?You can surely recover the amounts from your brothers by sending him a notice as he has taken the cash without your knowledge though you were a joint holder.
