How to proceed with divorce with an uncooperative wife

24-May-2023 (In Family Law)
My wife filed a complaint in women cell as we were not living together for about two years. I attended several counselling sessions and clearly stated there that I am not ready to call her back. Then I filed a divorce case. Even after filing the case in court, women cell were calling me again and again and in order to save my job, me and she decided that she will withdraw the case from women cell and in turn I have to withdraw the case in court. But I wrote in a letter at women cell that I will withdraw the case under favourable circumstances. I then informed wife that she and her family members need to contact my family for creating favourable circumstances. But till today, there has been no call from her family members. What should I do now to strong my case as I need the divorce as there are no favourable circumstances being created from their side.

Just to file a divorce before the family court against your wife along with evidence supports then court will consider and hope so may grant a decree of divorce in favour of you. This is the solution..

Please show us all your documents filed at the time of divorce petition. In case there is any amendment required, we can suggest you to strengthen your case to take divorce from your wife. Already desertion is the key point in your case. False allegations by your wife before the CAW cell is another point to strengthen your case because had it been the reality, your wife would not have closed the complaint with them.
