You can file application before the appropriate court for demanding your child custody.
Second thing you did not disclose the age of child. and third you also did not disclose that the status of your marriage.

Child is with whom? In your question it is not clear.If with wife ,how old your child is? What is your present income ?Is your child is going to school? Who has given the custody of your child to other partner?I would like to know all the above details then only we can go ahead
