You may submit an application to the Magistrate either directly or through the protection officer under the domestic violence Act.The details of the abuses and insults are to be explained clearly and claim the monetary relief and other reliefs provided under the Act

First you both need a family counselling after that you can decide accordingly to file a maintenance case or not.
