How to file case against torturous in laws

My marriage has been done in a way my husband is adopted...secondly mother in law mentally tortured me and also engaged me in black magic of some pandits and tantrik... after so much irritating atmosphere my husband and me decided to leave that house and now they are snatching his business from him and we are having 1 year old baby with us right now m also going through some neuro problems... kindly suggst me which sections i cam apply on my in laws?

You can file a criminal case against your mother in law as well as the tantrik who were involved in the black magic. Black magic is not allowed in our country. As for as shop is concerned you did not mention who has the ownership right of the shop.whether shop belongs to your husband or father in law. You did not mention in laws house is ancestral or self acquired. Information is incomplete. Feel free to contact in person for filing complaint

I have not understood whether your husband is living with you presently or not. It seems, there is domestic violence against you by your mother in law. In that case, you should file a case in district court i.e. Family Court for the prevention of domestic violence.

First of all, approach the local Police. They have a special unit for women and children. File a police complaint. The grounds could be domestic violence, mental torture and cruelty apart from other fraud meted out to your husband.
Regarding black magic, you can consult the local police about the inclusion of the appropriate provisions under sections 420 and 114 of the Indian Penal Code (IPC) as well as the section 7 (A) of the Drugs & Magic Remedy Act, 1954.
