Q: What to do if the dowry case is still filed from 20 years

My uncle got married in 1998 but he was not ready to accept the bride,it was arranged marriage as per local society. after few years the mother in law of my uncle filed a case of dowry against my entire family including My grandmother,My father,my mother,my next uncle & aunty.The time past & my uncle accepted the bride.They started living together & they have two son 10-5 yrs. but my aunty did not take down the case still now. Now as it happens in every family there arises some family dispute of property & being the separation of the family since my father is 3 brothers. Now every one of them is living separately & together with their family (wife) happily. But my aunty is not taking down the case due to dis family matter since she z of poor thinkin, illiterate & nasty mentality. The other family members r very much dippressed becoz of dis harrasing situation.We are in Delhi & d case z filed in bihar, we have to go every month in bihar & we cant afford legal & other chagres.plz suggst

It is unfortunate that the case is pending since long. Your uncle may approach the Hon'ble High Court for quashing of the dowry proceedings. In case his wife supports him, her affidavit can also be filed while filing a case for quashing of the dowry proceedings. If does not get justice from High Court, he may approach the Supreme Court, against the High Court Order.



Q: How to file case against torturous in laws

My marriage has been done in a way my husband is adopted...secondly mother in law mentally tortured me and also engaged me in black magic of some pandits and tantrik... after so much irritating atmosphere my husband and me decided to leave that house and now they are snatching his business from him and we are having 1 year old baby with us right now m also going through some neuro problems... kindly suggst me which sections i cam apply on my in laws?

I have not understood whether your husband is living with you presently or not. It seems, there is domestic violence against you by your mother in law. In that case, you should file a case in district court i.e. Family Court for the prevention of domestic violence.



Q: Procedure to take divorce from husband and marry somebody else

I want to divorce my husband. But they do not want to divorce me.I want divorce because I love someone else And I want to marry him. Please tell any such solution so that I may be separated from my husband without any tension

Sorry, this is no ground to get a divorce from husband. If you love someone why you got married to this person who is your husband ? In law , this is no ground to get divorce. On the contrary , your husband , if he wishes, can get divorce on the ground of adultery , if it is proved. If you have some solid grounds ( such as cruelty etc.) to get divorce, than only you can take divorce not otherwise. However, if your husband and you both are willing to get divorce by mutual consent, then you can take divorce by mutual consent. If only one spouse is willing to get divorce , it is not possible to have divorce by mutual consent.



Q: Procedure to file for divorce from husband

What r the legal procedure for divorce when girl isliving in her in law house. She has two kids also.she is living in joint family.

Divorce can be obtained from spouse either on mutual consent basis or other grounds , such as cruelty etc. Mutual Consent Divorce can be taken if both , husband and wife are mutually agreed for the divorce , not otherwise.For taking divorce on other grounds, such as cruelty, one has to file a proper case, contest it ( has to produce evidence etc.) , and if court will find genuine reasons , than only divorce will be granted. If wife is living in in-laws place , this has no bar to file a case for divorce provided there are sufficient reasons to file a case and to get divorce. In India, divorce at the 'will' of one party is not available.



Q: How to stop child abortion of my girlfriend legally

I and my girlfriend have been in physical relation and now she is two months pregnant and want abortion and i am agaist abortion and want my child to come in this world. what legal procedure i can take to stop her for abortion as im the father of the child. we are 26 MALE AND 23 Female above legal age.?

You have no legal right to do anything. You cannot stop your girl friend from abortion. You may be against abortion but think about the girl, why she should listen to you, you have put her in such situation! What ever you can do, can do mutually. Nothing can be done forcefully or legally.
