How can I throw my father out of the house legally

My Father has 2 wife. I m the son of 1st wife. We are 3 brothers. My father's 2nd wife has 6 children. He did not give divorce to my mother till now. He has many case against him. As per my knowledge, 2 murder case. He was leaving with his 2nd wife for last 30 years. His 2nd wife died 2 year back and now he is leaving with my mother in our house which we built 2 years back. But I am not interested in that. I don't want him to stay with us but unfortunately my mother wants him to stay with us. The land on which we built the house is in the name of my grand parents (My father has 4 brothers). Main problem is , he has a habit of scolding everyone, dunked every day. My son, wife as well as my younger brothers also don't want him to stay with us. They are not feeling safe. Unfortunately my mother wants. Even he beat my mother sometimes. He is a goon. I fear for my life and my family's life if i argue with him. Please advice us how we can throw him out of our house

You have not mentioned whether you are Hindu or Muslim.Any way that chapter is over. Whether your father has any share over the house you are staying now?Try to mention your owneship title over the building in detail so that it would be easy to give any suggestion

U can't throw your father legally from his father's property.If he is misbehaving with your mother and ladies member, they can complain to police.Better u avoid tussle with your father.or else live separately.

If the properties belongs to grand father you cant remove him, but claim your share
If your mother wants her then you cant separate them,
The best available option file partitions suit and get separated yourself from him.

Dear client,
As social point of view first of all i suggest you don't use such type of words against your father, Then in legal point is that:- The house is buildup in the land of parental property.Your father has every right as a successor,so you can not prohibited him ,if you have self acquired property then it is a point to think that aspect. its better to take the matter in the notice of a family counselling center or in your state commission for human rights for amicable settlement the problem.

From your post I understand your mother is great and accepting yr father even under adverse circumstances .further u will always remain in fear even if u throw out yr father as he may come and beat u and other family members.so just give him enough drink and compromise with the issue ,time will solve it .it doesn't require any legal action .
