How can both parties in a case settle it in court
26-Jul-2023 (In Family Law)
Dear sir, I JUST WANT TO KNOW THAT IF A PERSON WANT TO SETTLE DISPUTE IN FRONT OF JUDGE & OPPOSITE PARTY GO FOR BAIL ON SAME DAY & IN SAME CASE. IN THAT CASE BAIL IS NECESSARY FOR THAT PERSON.
it depends upon the situation under which sections you r opting for bail u can say in ur arguments before the court that interim settlement is under process out of the court some short date can be given to u and both the parties can file a joint affidavit that interim settlement has been done.
On the above-mentioned query firstly both the parties settle the matter outside of the court. Then with the help of government lawyer statement of the complaint/plaintiff/applicant under section 313 criminal procedure code is recorded in front of the preciding officer on the case file and then the case is closed if the preciding officer is satisfied with the statement under section 313 criminal procedure code.
