Can a maintenance case under HMA24 be filed in court outside India if divorce proceedings are running in India ?

Query perused. No. An application under section 24 of the Hindu Marriage Act, seeking Maintenance pendente lite and expenses of proceedings. — had to be filed before the same judge who has seized off the divorce proceedings in India. For further consultancy and legal services you may contact us.

Hi, The jurisdiction for Maintenance application under section 24 HMA is within India only. HMA is not applicable in foreign countries. There are different laws and provision depending upon the state you are living in. Thanks Ramit Sehrawat Advocate
