Hindu Female Husband Committed Suicide Divorce Pending

Hello, I had asked husband for a fertility test pre marriage and he had refused and given the hormone testosterone instead claiming it is an alternative to a fertility test, he's an MBBS. After we did not conceive husband gave semen analysis which revealed that he is infertile, he agreed to use donor sperm but later backed out of accepting our donor sperm conceived child. I have recorded conversations with his ex wife and she revealed that they had tried for a baby for over two years she has a son from her second marriage. I also have a recorded conversation with his sister where she claims that his ex girlfriend had conceived twice and had two abortions and I have screenshots from the ex girlfriend that she never conceived. I filed a case of cheating and premarital concealment of infertility on husband. Husband recently committed suicide.Can I be charged with abetment to suicide? Will I and my daughter inherit his property?

yes you and your child are his legal heirs and will surely inherit all his properties and money without any doubt hope he has not declared anywhere that he has blamed you for the same that he has committed there is nothing to worry as it needs to be proved

There are chances of you being charges on abatement however need to understand in detail the chronology of events and the implications which has caused because of this. Inheriting of property comes as secondary as it depends on the charges if charged. Consult me if you need further assistance.

to my modest understanding your criminal case against your deceased husband are both not sustainable. be it as it may everyone in law is entitled to file cases against anyone and if the person against whom the complaint has been made commits suicide because of the embarrassment it cannot per se be called abetment for suicide. however if more facts get revealed in due course of investigation then charges of abetment has to be decided after taking a holistic view of the facts. in any case the law and equity dictates that if someone has caused the death of a person then he or she cannot inherit the deceased person's property.
