Harassments happening under 498 case filed by Wife

My wife filed 498 case against me, my mom and dad in Rajasthan. My wife family is congress political person because of that Judge is biased and he issued arrest warrant against me, my mom and dad. We filed warrant cancellation but he again denied. I asked my advocate to request case transfer to Jaipur high court and submit warrant cancellation in HC. But he is saying we need to submit warrant cancellation and mom/dad discharge application in Session court first before we move to HC. My mom and dad has nothing to do in this case. My wife never lived with my parents. How can we proceed further to get us justice and relief, My parents are suffering. Is there any law we can directly go to High Court? Please advice.

Hello, you can move the petition u/s 482 crpc in rajasthan highcourt for quashing the FIR against your father and mother....if your wife never lived with your parents then not to worry...after investigation police will submit the challan only against you...after the arnesh kumar vs state of Bihar case police will not arrest any of you if you people join the investigation whenever needed...for further discussion do contact personally....

Yes, you can directly go the High court by exercising the inherent powers of the High Court under Section 482 of the CrPC. You can claim appropriate interim relief so that your parents suffering can be mitigated. You may also claim change in investigating agency if you have reasons to believe that they'll be biased.
