Harassed by in laws how can I claim maintenance from my husband

From beginning in-laws tortured me .startrd life n seperate houseaftrr few months.my mother in-law has major influence on my hubby so issues continued gave birth to girl now he left me alone taking my daughter. I m mot workinh women.Should I file case against my in-laws under dv act or maintenance case I don't want to give divorce. I hope my husband will come back

I would like to know, what exactly you are looking at - Getting maintenance for you and your daughter or prosecuting your in-laws for torturing you. If your intention is to get maintenance alone then you need to initiate proceedings against your husband under Sec.125 Cr.P.C. otherwise you can file a complaint before appropriate court under DV act. DV act provides an exhaustive remedy, under DV act you can seek several remedies including protection order, monetary and compensatory relief, custody order (for custody of children) etc. From your wordings, I understood that you want to live with your husband but want protection from your in-laws harassment. So, my advise would be to approach the Court under Domestic Violence Act with appropriate prayer.

you can very well approach the family court for claiming maintenance as well as custody of the child.meanwhile, you can lodge a complaint in nearby All Women Police Station against your husband and in laws for torture. if the complaint is not taken on file then you can file petition under jurisdictional local court under DV Act.
