Guardianship of a child by a non-relative

How can a non-relative get guardianship of a child in India? Father is expired. Mother is willing to give guardianship as she is not earning and unable to fulfil child's needs.

In the absence of father, mother would be deemed to be natural guardian and will be made guardian of child. Non relative can have guardianship only in case of death of both the parents of child. Instead go for adoption. By pass the process of court.

You can file a petition under Guardians and Wards Act and can get the custody of the child.

Bonafide has to be shown. That the welfare of child is with you as you will be able to impart good education to them etc.
