Got married in arya samaj mandir but not in court

I have get married in arya samaj mandir but not in court. After 3 day with the help of police girls brother found us. 164 statement recorded against me girl is major 25 years. But i have all proofs of arya samaj marriage photos and certificate. Also have chat of 6 years with girl. I was behind bars for 3 months (365,366IPC). Now i am on bail. Meanwhile they marriage that girl with another guy without any divorce. Is my marriage legal or not? Can i file section 9 as i have a case on trial?? What legal remedies they can use if i sue them?

Hello if the girl is adult and you are also in the marriageable age the marriage solemnised in the Arya samaj mandir is legal and valid. you can file the case under section 9 Hindu marriage act. for restitution of conjugal rights. You can file application for discharge in the court or for quashing FIR.

Yes if you have all the proofs and the marriage is conducted by all the Hindu rites and ceremonies your marriage is legal. Furthermore, the second marriage of you wife is illegal and is not valid as per the provisions of law.
