07-Feb-2023 (In Family Law)
I need to file a divorce based on cruelty and desertion,if they find a lack of evidence in one ground, can they dismiss the divorce petition? in other words, if I file divorce on two grounds and if one ground does not have enough evidence will that be dismissed and I have to file a new petition on one ground like Desertion or cruelty?

you can file any grounds for filing divorce like cruelty, dissertion, non consummated etc but if it really happened then we can put it in the petition, the court will consider the grounds and if there is no possibilities if reunion and continue of cruelty then will grant divorce in the specified ground the evidence is a must for continuous cruelty

usually you can file divorce on the grounds available to you as provided by law. whatever it may be cruelty or desertion you must prove the facts of the case by evidence. if you are not able to prove by evidence there is no use to file the divorce on multiple grounds.

yes you can file petition on two grounds and factually if you are able to prove the ground raised then it’s your case of winning. Dismissal of one grounds for not proving the case is not the ground for dismissing the entire case itself
