Father receiving pension not taking any responsibility of mother

03-Apr-2024 (In Family Law)
My father(73) is ex govt employee and receives pension each month. Of late he is adamant on not taking any responsibility of my mother(71). Her medicines, basic requirements, or anything relevant is being taken care by me. My father doesn't give a single rupee to my mother from his pension and completely shifts the balance to me saying I need to do everything and he has no responsibility in giving any money or spending anything for my mother's sake. I am working. Is there a legal remedy?

Ans. The Maintenance and Welfare of Parents and Senior Citizens Act 2007 envisages providing need based maintenance to the parents/grand parents from their children. Tribunals will be set up for the purpose of settling the maintenance claims of the parents in a time bound manner. Lawyers are barred from participating in the proceedings of the Tribunals at any stage.

yes your mother has to file a petition under section 125 of criminal procedure code in family court, the court will definitely pass order for maintenance and your mother will receive her maintenance.
