Father in law threatning to destroy my life if I live with my wife

14-Mar-2023 (In Family Law)
Dear Sir, i was in love with my girlfriend for past 7 years. Our family know each other, my parents presented the love affair(before 3 years) and proceed with marriage proposal and they did not respond .During her final training section on January 2016 they keep her as house arrest for 15 days and her father was threatening her to quit our relationship. At last she agreed with her father and came back for training. Then we decided to get married and we are married on April 2016 under the special marriage act,but we did not inform anyone .At present she informed her father about our marriage.Again her father doesn't want us to be together and he started blackmailing that he will threaten my life and he will destroy her family by divorcing her mother too.at last due to pressure she texted me that she cannot come with me and have to do what ever her dad says, other wise he will destroy everything.please advice, assuming that she cannot support me in the court.I want her back in my life.

Once she is married she cannot say she cannot live with you, so it is better you meet her personally and ask her to join you, if she does not agree you can file a case for restitution of conjugal rights in court or you can both go for mutual consent divorce if things are not working, her father is emotionaly trying to separate you, she can join and both of you can issue a legal notice, and even if he eants to divorce, getting divorce is not easy he has to pay permanent alimony and also prove the grounds on which he wants divorce.

You can seek for protection for you life from the police. As you informed both are married and becuase of her father she is scaring to live with you. In case if she want to live with you, she can file a case for protection or you also can file a case against her father for restraining her to have family life.

In case if she cannot support you and you desire to live with her, then you can file the Case for the restitution of Conjugal right. First you prove that you are husband and wife. Then file necessary application to ring back her.

You can send her a notice through a lawyer asking her to come back to perform her marital obligations. If she does not comply with the notice, then you can file for restitution of conjugal rights before the family court.
