Father in law misusing rights of senior citizen act and troubling Son

19-Nov-2023 (In Family Law)
My father in law is a habitual liar, he was jobless for many years. He sold his own house to cover loan and today has got ancestral property share +pension. But he is telling us half amount of the share and shows that he does not have much money with him. We want to stay separate but he says he does not have money which is a lie. He is taking advantage of senior citizens act and has 10000 rupees for himself still asking for maintenance and denying for staying separate.

If the Senior Citizens Maintenance Tribunal has passed an order against you to pay the ₹10,000 each month for maintenance despite the fact that your father-in-law earns or has sufficient funds, then you’ll have to challenge the said order by way of a written petition before the High Court.

Well morally, Father in Law doesn't seem wrong, being at old age, if he want his children to live with him, expecting, that, the children who have become matured and grown up will take care of him, then, where he is wrong by not allowing you to get separated from him! You guys being couple can find space for each other under the shelter of Grandfather's House too. Legally, if you want to fight with him to deny maintenance, then, you have to prove that you cannot grant maintenance to him, since you cannot afford.
