Family matters on inheritance dispute

We are family of 5. Brother me mom bhabhi nephew. Brother is married but his wife is bit problematic. So want legal advice. How to stay away. This home is in name of mom bhai bhabhi. If I want to take mom aside. How can I go with it. Bhabhi mom is torture.
First of all make it clear whether home belongs to your father. If so, you and mom will have share in it. Otherwise you can take share of your mom and can move away if property is earned by your mother and brother jointly.

You can take mom aside and make her gift the property to you and your and her share will be intact. (even if no gift)
But you cannot remove bhai bhabhi or sell the flat.
