Family Court has issued FLW (Fine Levy Warrant), any legal recourse available​

My brother suffered a stroke in 2013, and since then, he has been unable to pay the maintenance amount. The court has asked my father to deposit ₹1.5 lakhs, but he refused as he cannot afford such a large amount. As a result, the judge issued an FLW (Fine Levy Warrant). Is there any legal way to challenge this? This feels like a case of injustice.

According to the law, you must either deposit the amount or face civil imprisonment. If the wife does not demand more money, the court may consider the situation on humanitarian grounds. However, in this case, that is not happening. So, think carefully, as the law is strict in such matters.

Your brother must prove to the court that he is genuinely unable to pay the full amount and should offer to pay whatever he can afford. If he does not do this, the court may not believe his claim. He should file an application explaining his financial condition. If the judge rejects it, he can approach a higher court by filing a criminal petition.

Being punctual in court is very important. If your brother is unable to pay, he may request more time. However, if he is absent, he cannot avoid legal action. As per the law, the court has the right to take action against him. After appearing in court, he can request additional time if needed.
