Execution Order After Maintenance Order


17-May-2024 (In Family Law)
Maintenance order have been passed on 20/01/24 interim; execution notice got on 17/05/2024; Maintenance paid regularly; Now my opponent party ie my wife didn't visit my minor girl child; what to do?? I think for two options; wheather I stop my maintenance to wife but continue my daughter maintenance?? Or I filed child custody case for visitation rights as well?? Which would be the better option?? Or both options are appropriate?? Please suggest

If maintenance is paid regularly then you wouldn't have received an execution notice. I am still unable to understand your query as a few important details are missing here. One thing which I could assess is that you shouldn't stop the maintenance hence ordered, it would be more wise to appeal the order of the Learned Court.

dear client as per your query the order was passed for maintenance and you are paying maintenance if you are not allowed to visit your daughter,then you can apply for custody of the child what is the age of your child as per supreme order girl child below the age of 5 father won't get custody if mother is unable to maintain or is of insane mind then only father will get the custody of the child..
