ex parte stay order by Bombay HC for eviction order by senior citizen

it is a mumbai property case.senior citizen tribunal order for eviction was passed on 22 dec 2022 against "elder son" of mother. 22 jan was last date for eviction. elder son appeal in Bombay HC 20 jan 2023. Son has alternate flat in mumbai then also he is in possession of sra flat nwhich is in name of mother. son said in HC that OC not recd for his flatn HC said to produce OC of son flat so that time may be given for eviction.taking advantage of his daughter hsc exam he without giving any application copy to us got ex parte stay order on 24 feb 2023. HC granted stay till 21 april 2023. hsc commerce side exam ends on 13 mar 2023. nHow HC gave exparte order. and how date of stay is given upto 21 april 2023HC said as mother stays in younger son house so no urgency to decide case. younger son lives in rented chawl roomwhat is the remedy now

You will receive notice of the case and you will have to represent yourself through counsel on the stated date. Before that date you may file your reply to the petition filed by your elder son. You may ask your counsel to mention before the court to prep one the date if you have a real urgency
