Dusri shadi ke bad pension ka adhikar kise

Mere pati ka dehant june 2021 me ho gaya wo forest department me guard the Or 2010 me retire ho gaye the unko jo pension mil rahi thi wo ab tragery ke adhikari hame dene se mana kar rahe hain. Kyunki mai unki dusri patni hu. Meri shadi court marriage unse 2011 me hui thi. Unke retire hone ke bad jabki unki pahli patni ki death 2009 me hi ho gai thi. Ab kya mera hak unki pension par nhi hai.. Ese me hame kya karna chahiye.. Plz advice...

husband ki death k baad uski pension pr kanooni adhikari uski pehli patny ka hi h yadi aapne first wife k mrne k baad sadi ki h to aapke husband ko aapka naam service record me as a nomni drg karana thaa jo sayad nhi karata kanoon ki nagar me court marriage ki koi value nhi h jb tk saptpadi na hui ho

Aagar aapke pati ne apne pehle patni se talak liya tha fir uske baad aapke saath shaadi ki the to aap unki legal wedded wife hue us hisaab se aapko wo saare haq milenge jo ki ek legal wife ko milte hai aur phir aapke case mein to aapki shaadi unke pehle wife k marne ke baad hui hai to is hisaab se aapki shaadi legal hui bus aapke husband ne apne records mein mention nahi kiya hoga doosri shaadi ki is waje se aapko pension nahi mil rahi hai high court ke order k baad aapka kaam ho jaaega

apko he adhikar ha unki pension lene k leya.. just bcse first wife died in 2009 and you are now his legal wife according to the paper so make a writ in High court you will be directed by the court to take pension of your legal husband. thanks adv utkarsh khanna advocate High court
