Divorce - Working spouse can get alimony?

17-Sep-2023 (In Family Law)
Hi Team, I got married an year ago. I came to know that my husband married me for my money. He is not interested in running family in peace or harmony. He took my jewels as well. I was working before my marriage. Due to minor accident, I quit my job post marriage. My husband took my PF amount as well completely. I decided it is no use to continue married life with him. I 'm planning to apply divorce. Kindly let me know how to get my jewels and money back. Now I'm working and living with my parents. Also my husband has some mental illness. My MIL, FIL are aware of their son't mental illness. No kid for me.Still they did marriage for him. In this case, please advice me. Is there any way to get alimony?

Hi,
Madam you can file a complaint against your husband for cheating and harassment (Your nearest police station) That based u can claim back your jewels, money including PF amount .Then after u can file a divorce petition on the grounds of mental illness (mental disorder) ,next u can file a maintenance case under section 125 CrPC
a) Marriage certificate with wedding card, wedding photo, b) Residential address of both the parties c) Office/place of work of both the parties .where you have to file approach an advocate then the advocate will decided where to file the case, if you wish to file a case( your place or husband place) advocate will file that place. This is the standard procedure of claiming maintenance.
