I have one son from first wife and did second marriage.. My wife is not living with me and asking to send my 5 year old son to hostel and leave mother to village home.. In 2 years, she lived only few months with me and now at her home last 6 months... What legal action i can take to get separated...
at present where your son is staying it's with you or your wife secondly you may file a case for divorce in family court. on grounds of cruelty and desertion. ofcoarse it is illegal to get marriage with out getting divorce from first wife. did your first wife know about it. if your wife proove in If your wife goes to court for the custody of the child, then she will have to tell the court how she will be able to raise her up better if she can not tell it, then the court will not give her child custody, and when the child is more than 12 years old If the child wants to live, the court will give the custody of the child to him.
