My frnd husband filed divorce petition on cruelty desertion. In laws sent her to parent's home after a month of marriage since they couldn't take care of her due to pregnancy.After delivery husband used to visit one or two times n that also stopped.No one came to take her back n no money given by husband to meet there need's. She raised the female child alone n even during corona peak times hus didnt check with her or child n she stopped talking to Hus to avoid fights bec hus staying with inlaws.tats were it went wrong n inlaws used tat gap n brainwashed hus n she waited for her husband since its love marriage n he will understand n come but went vain. Wen child attained 1.5yrs they came for formality n wen my frnd shouted for all there wrong doings they simply went- not even shown interest in seeing baby face n after few days they sent divorce notice.I think they waited for 2 yrs of seperation to file. How to fight back n wat to do to get back n break the case.can we dismiss the case!

Your friend needs to contest the case if the case is already filed, using her side of facts. She can file maintenance and domestic violence cases depending on the facts and circumstances. Now only notice is sent by husband to which your friend has to send reply with the help of a lawyer.

you should file immediately case for restitution of conjugal rights and you also should contested divorce case very seriously and the written statement in the divorce case must counter all the allegation made in the divorce petition and state the real nature of the dispersion by your husband that is not your fault and that is the fault of your husband who neglected you and fork reality you must deny all the grounds and what is the actual happenings you must state in the written statement along with the evidentiary value
