Divorce and joint property issues

10-Aug-2023 (In Family Law)
Hello, I bought a property (bank financed) and registered it under both mine and my wife's name. The loan however is under my name and I pay the entire EMI. Our divorce is underway and my wife refuses to let me sell the property. What are my options ?

This kind of situation is not unusual. Out of love and affection husband registers the property in joint name, and the property will stand still but the marriage won't. First you need to file a civil case to declare that the property is solely funded by you and that your wife did not contribute any money towards purchase of the same.

property is different from the divorce case device is only regarding the Marshall status that property is regarding the ownership so you are saying you are paying the EMI and loan stands your name but you have purchased in the joint name your wife maker Manch a different variations that he give money to you and through you hi paste I am so this is a civil dispute you should go to the Civil Court to declare USA complete one hour notice your wife

you have file the suit for declaration and thereby get decree and prove your wife is only a name lender. you have to produce your documents which evidencing your payment to bank. and also prove that your wife didn't have any income source.
