Harassment of an elderly mother by her own daughter is not only emotionally distressing but also a serious legal matter. There are several provisions under Indian law, including the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, that can provide immediate protection and legal recourse. I would be happy to guide you through the process of filing a police complaint, drafting the necessary documents, and ensuring that your rights—and the safety of the elderly mother—are fully protected. Since each case is sensitive and unique, I recommend a quick call to discuss the specifics.

If an elderly mother is facing harassment by her daughter at home, she has the right to seek protection under Indian law. The mother (or a legal representative) can file a police complaint detailing the abuse—whether verbal, physical, emotional, or economic. The complaint should mention specific incidents, dates, and any available evidence like recordings or medical reports. The matter falls under several legal provisions: Sections 323, 504, 506, and 509 of the Indian Penal Code (IPC) deal with assault, threats, and insult. Additionally, under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, the mother can seek protection, maintenance, and even eviction of the abusive child from the shared residence.
