Changing surname of my children
14-Sep-2023 (In Family Law)
Hi,
This is in regard to change of my daughters surname. I've three daughters of 4 yrs age (twins) and a 3 months old baby girl. New born baby name is not finalized yet due to which birth certificate is not taken. I want to discontinue my surname as it may create a problem to my children future (as it indicates some type of caste sometimes) and keep a new surname for all my daughters. Since birth certificate of new born baby is not taken, can i give new surname in the birth certificate application form ?
How to change the surname & what is the procedure to follow to do the same in my elder twin daughters case ?
Do I need to take anyones permission in written ?
What could be the consequences in future to me and my new born baby if I change it without taking legal formalities (if there are any) ? From my family side (wife, parents), there is no issue in changing the surname.
Firstly, while submitting application for birth certificate, you can provide any surname for your new born baby and same will continue in future.
Regarding other twin babies names, if you want to change the surname in the documents i.e birth certificate, aadhar card etc, you have to file declaration suit making authorities as defendants , prior to filing declaration you have to issue notice to them , if there is any urgency you can ask for dispensation, consequences may raises in many ways at anytime in future when there is conflicting names in documents.
