Chances to get alimony after the retirement of husband

Sir We both work in central govt job,due to physical torture had to complaint and 398A case registered in 2011.both children are with me studying .one is 23 other 16yrs.Now my husband going to retire in October.what are my changes to get alimony and money for children.also we have 1kattah land in joint name ,he's asking for share.plz advice urgent as his retirement is in October 18.

The income of the wife may be taken for granted for determining the amount of maintenance and her eligibility. If the wife of her own volition pursues a career where she earns her own income, then the sufficiency of that income is to be seen and calculated to reject or grant her claim of maintenance. Apart, the land, if is jointly owned by both of you, you are eligible to get your share. But definitely you are at your freedom to sell your part or not!

Your husband is bound to maintain the children as well as you till his last breathe whether he is employed or unemployed or retired, it hardly matters.

You are supposed to get 50% share of all his property and assets as well as 25% of his slary or retirement amount every month
