Case proceeding in court can it be transfered to another city

02-Jul-2023 (In Family Law)
We have filed a transfer petition for transferring my daughter's divorse case to a different state. As stay is not yet granted, the opposite lawyer has started the case proceedings now. My question is once the case is transferred, will it start from the beginning in the new court or they will continue the case from where it is left in trial court?

Transfer to a different state court means whole court record will be transferred so court will continue from the stage which is held up by the other court. But still you have to check with the concerned court as it depends upon the discretion of judges also hence check the same once in the concerned court for confirmation.

Case was start fresh from begining. Issuing summons, later same statement will be filed later case will go in. Court has descretinatiory power to transfer or not depending upon facts and circumstances u have provided in ur case cause of action transfer.

When no order is passed to transfer the case, naturally other side advocate proceed with the case. If case is transferred to other court, the case will proceed where it is left in the trial court. There wont be any fresh hearing of the case.
