Can my Husband Issue Notice to me on grounds of leaving his house?
30-Dec-2023 (In Family Law)
I have been married for 11 years now and have a daughter, I want to stay separately with my husband and my daughter without my in-laws for which my husband is not agreeing.
Would like to know if my husband can issue a notice to me as I have left his house 6 months back because of fights over money and my mother-in-law.
If Yes, how can I proceed further? Please Suggest.
He can’t force you to stay with the in-laws. He can however issue a notice for restitution which you’d have yo defend.
Now that he has issued a legal notice, you can issue a response indicating you are willing to stay with him, but separately and until such time, you’d not be agreeable to reside in the same premises as that of the one with in-laws.
