Can I evict my daughter in law and my two grand children from my flat

27-Nov-2023 (In Family Law)
I am a senior woman citizen aged 75 years staying in Mumbai in a self acquired flat with my eldest daughter aged 55 and my daughter-in-law aged 46 and my two grand daughters aged 20 and 14. My husband passed away in 2001 and my only son passed away in 2012. I have no means of income and my eldest daughter is of unstable state of mind. As of now, I am living off a reverse mortgage loan which ends in April 2020 and which the bank will not renew. My liability to the bank at the end of 5 years together with interest @ 11.75% p. a. will amount to Rs. 25 Lacs. The only way for me to pay the bank loan and also to live the remaining years of my life honorably is to sell my existing flat and move to a cheaper locality and smaller flat. This way I can repay the bank loan and also put the remaining amount in fixed income instruments. However, my daughter-in-law is putting a hurdle and prevents any buyer from moving ahead by saying that she will not handover peaceful possession of the flat.
