Section 9 Hindu Marriage Act (Restitution of Conjugal Rights)

Your mother can live separately. section 9 only proves that your father is ready to live with her. And your father didn't abandon her. this order doesn't compel your mother to live with him. If your mother didn't comply section 9 order, the only consequences is that there will be arises some diffidently to gain alimony. And this can be a valid ground for divorce.

6. Practical Legal Steps for Your Mother 1. Written Representation to SSP / DM: Ki unhe pati ke saath zabardasti bhejne ki koshish na ho, kyunki jaan ko khatra hai. 2. Stay Order Application (if needed): Agar husband zabardasti ghar le jaane aaye to, Civil Court me injunction application file karo. 3. Separate Residence: DV Act ka Section 17 wife ko “right to reside in a shared household” deta hai. Agar wo ghar husband ke saath nahi rehna chahti, to alag accommodation choose kar sakti hai. 4. Affidavit in Court: Ki unhe koi alimony/maintenance nahi chahiye, bas suraksha aur alag jeene ka haq chahiye. 5. Emergency Protection: Agar harassment continue hoti hai to High Court me writ petition under Article 226 (Right to Life & Liberty) file ki ja sakti hai.

Here’s a suitable response you can post: Your mother cannot be forced to live with your father against her will. Even if the DV case was dismissed, she still has the right to live separately for her safety and peace of mind. Section 9 (Restitution of Conjugal Rights) is not an order for “physical force” – the court cannot drag her back to his house. If there is threat to her life, she can approach police under IPC sections for protection, or file fresh DV/Section 498A case with stronger evidence. She can also file for judicial separation or divorce again – dismissal of one case doesn’t end her right to file afresh. Every person has the fundamental right to live with dignity and safety under Article 21 of the Constitution.
