Q: Legal Advice Needed on Property OwnershiP
I own a property that was previously owned by SC/ST families and has passed through 4 previous owners before I purchased it from a general caste person. I want to know if my ownership is fully legal and safe.If there is any risk, please advise me on what steps I need to take to secure my ownership.
Advocate Honey Pamnani answered
Generally, many states have laws restricting transfer of land allotted to SC/ST persons (e.g., under land reforms or government grants). If such land was transferred without prior permission of the competent authority or in violation of the grant conditions, the transfer can be declared void, and the land may be restored to the original SC/ST family, even after multiple subsequent sales. However, your title is usually considered safe if:The land was not a government-granted or allotted land, but privately owned ancestral/self-acquired land. The initial transfer from the SC/ST owner was lawful, with required permission (if applicable). All sale deeds are registered, stamped, and there is an unbroken chain of title. No restoration proceedings, notices, or litigation are pending.
Q: Share Demand of Selled Property
Ek property sell ki thi maine jisme 2 co-owner or the and jo property sell ka paisa tha 1co-owner ke khate mai gya to ab 2 saal se wo bs ghuma raha h paise nhi de raha to kya isme kuch ho skta h. Sell Deed mai naam bhi h mera
Advocate Honey Pamnani answered
Agar aap co-owner the aur Sale Deed me aapka naam bhi hai, lekin sale consideration (paise) sirf doosre co-owner ke account me gaye aur wo 2 saal se aapko aapka hissa nahi de raha, to yeh serious legal issue hai. Aapke paas ye remedies available hain:Civil Suit for Recovery of MoneyAap apne share ke paison ke liye recovery suit file kar sakte hain. Sale Deed proof hai ki aap seller the, isliye aapka hissa legally due hai.Suit for Rendition of AccountsAap court se demand kar sakte hain ki doosra co-owner sale amount ka poora hisaab de aur aapka share release kare.Legal NoticeSabse pehle ek strong legal notice bhejna chahiye, jisme time limit dekar payment maangi jaaye. Kai cases notice se hi settle ho jaate hain.Criminal Action (if intention dishonest ho)Agar shuru se hi niyat paisa dabane ki thi, to IPC 406 (Criminal Breach of Trust.
Q: Mujh ek ladke k upr rape ka case karwana hai
Mene ek ladke k sath sex kya tha ab m us pr case kar chati hu rape ka ...mujh kya kya karna chaiye case FIR karne aur chargesheet lagwane k 1 lakh rupees dungi
Advocate Honey Pamnani answered
Aapke query ke facts ke according sabse pehle yeh samajhna zaroori hai ki rape ka case tabhi banta hai jab sexual relation bina consent ke ho ya phir false promise of marriage, force, threat, intoxication, ya consent vitiated ho.Agar aapne apni marzi se, bina kisi pressure ke sex kiya tha, to baad me sirf badla lene ya paise ke liye rape ka FIR karna kanooni jurm hai aur IPC 182/211 jaise sections me aap khud bhi fas sakti hain.Agar waqai sex aapki marzi ke khilaf hua hai, to aap turant:Nearest police station me written complaint/FIR dijiyeMedical examination karaiyeEvidence (chat, call recording, messages) preserve kijiye
Q: Late Birth Registration (Varanasi) - SDM Order Denial
I was born in Varanasi, and my family shifted to Gujarat after my birth. My birth was never registered. After 35 years, while trying to register it, the sub divisional magistrate denied the order citing Aadhaar Card address is not from UP. I also subumitted school leaving certificate, 10th marksheet, and passport as proof of date of birth. Is it legal to deny birth registration based on Aadhar address considering new UP govt. ruling that Aadhar card is invalid document for bitrth registration
Advocate Honey Pamnani answered
No, denial of delayed birth registration solely on the basis that your Aadhaar address is not from Uttar Pradesh is not legally sustainable.Under the Registration of Births and Deaths Act, 1969, the place of registration depends on the place of birth, not on the present address of the applicant. Since you were born in Varanasi, the competent authority in UP has jurisdiction to register the birth, even if your family later shifted to Gujarat. For delayed registration (after 1 year), the law requires an order of the Sub-Divisional Magistrate/Executive Magistrate along with documentary proof of date and place of birth.
Q: Kya hum dusre district ki session family court ki file nikalwa sakte h
Kya hum dusre district ki session family court ki file nikalwa sakte hain.apne jile se online
Advocate Honey Pamnani answered
