Can a son in law file a case against his step mother in law

my step mother in law has illegally used her name in my wife's school certificates while the real mother of my wife is still there. Actually my step mother in law is also a govt servant who is illegally married to my father in law as my father in law has not divorced his first wife.what actions can i take now being the son in law and will the step mother in law lose her govt job

Sir, If you can initiate a criminal case against your step mother in law and have her arrested and kept behind bars for more than 48 hours, she will lose her Government service. Please call for more details.

Ask your wife to lodge an FIR against your step mother in law on grounds of cheating and fraud and using her name without consent, your wife has to strongly object before court of law to jail the step mother in law.

By a power of attorney a person can sign on the affidavit and petition filed in court but the case has to be in the name of your real mother in law. But appropriate person would be your wife as she would have better knowledge of the fact. Your wife as a major can also file case for declaration regarding the real mother in Civil court.

Yes definitely anyone can file case against anyone. You will just have to ensure two things:- First one is that you will have to show the Court that you are an effected person sue to the act of the opposite party and Second one, that there is a cause of action. Your step mother is a Government service holder, therefore unless she is convicted with any crime or there is a question on her morality, the Government may not terminate her. But at the same time it is completely discretion of the Employer to keep or fire an employee due to his/her act outside the course of employment, provided the employee is not a proved terrorist or is a treason.
