There is no illegality for a Muslim man marrying second wife without divorcing the first wife. You will have to maintain equality between both and rights of wives should be given. Criminal case from first wife is maintainable

From your query I could not understand your religion where as in the Heading it says MUSLIM. Under the impression as Muslim I am answering the question.
A muslim man can have 4 wives at a time. The Muslim personal law permits that. If your financial status allows there is no impediment in contracting marriage with another lady. Normally it will not in any way create any issues to your case pending....

It appears that you have not disclosed the complete facts. Was the first marriage according to Muslim rights and the wife,a Muslim? If yes, you can marry a second time even during the subsistence of the first marriage. However, you need to obtain permission from the Government, if you are a Government servant.
