Can a marriage happen between cousins as per Hindu Law

I am hindu brahmin basically from Uttar pradesh and but born and brought up in Rajasthan. I want to marry my cousin ( Daughter of my mother's real sister). My age is 37 and her is 30. She is married with another guy but she want to leave him and want to marry and live with me. We both are ready to face society. Now please help and guide what should we do? what the best way to avoid any legal consequences ? Is it ok that she give an application to local SP stating that she dont want live with that guy and she want to live anywhere else seperatlly? Looking forward to hear back from you ASAP. You r help and time will be highly appreciated

First of all without taking decree of divorce she can't marry anyone as per Hindu law and IPC. She can marry after taking divorce. If any one is aggrieved and file any case against your marriage then you may file reply.

you are by caste brahmin hence asper hindu law both of you can not marry . but if you want to face the society than you can marry as per special marriage act.if she does not want to leave with her husband than she should take divorce n get marry with you.

you can marry with ur cousin but after divorce. before marriage both of u can live together in live in relationship. but it will cause trouble for u because making physical relation with wife of another person is liable to be prosecuted for adultery. give an application to sp stating that her husband causing cruelty with her mentally and physically and he is demanding dowry and giving three degree physical torture and also commits unnatural sex. suggest her to file FIR against her in-laws and husband U/S 323, 354,498A,406,377 IPC. also file application under domestic violence and maintenance. in application of SP also mention that after throwing her out from home by husband and in-laws you provided her accommodation and financial help because her parents are also not supporting her. because of this she is residing with u. after it u will not be guilty for adultery. after all this you have to file petition for protection before high court and than both of u will be safe. act on it . best of luck
