Sir, i was in love with a boy and he said that he will marry me under any circumstances. By beleiving his words we had a physical relationship at the hotel and i have some photos with me. Now a few days before he is engaged with a girl. So i want to know if i file a case against him, whether there are 100% probability to win that case.
You can file case against him.. Criminal as well as civil .. Criminal case if filed properly can spoil the present marriage proposal.. Civil case, you can claim compensation, though such procedures are rare and not adopted my people much..
The question, whether you had consented to the physical relationship because of his promise to marry? If so, you can file a criminal case against him. Whether he will convicted or otherwise is a matter of evidence whether, but not for this promise, you would not have consented to physical relationship.
You can file detailed complaint against him for committing physical relationship with you under the promise of marriage and cheating. There is every chance of wining the case subject to the evidence adduced by you.
Having sex with a girl on the promise of marriage and later refusing to tie the knot on flimsy grounds amounts to commission of rape particularly when the boy from very inception had no intention of marrying the girl.if a fully grown up girl consents to the act of sexual intercourse on a promise of marriage and continues to indulge in such activity until she becomes pregnant it is an act of promiscuity on her part and not an act induced by misconception of fact and Section 90 IPC cannot be invoked unless the court can be assured that from the inception accused never intended to marry her.
So file a complaint before local police station .If the accused persuaded a girl of tender age that he would marry her then such consent was not obtained voluntarily but under a misconception of fact and the accused right from the beginning never intended to fulfill the promise. Such fraudulent consent cannot be said to be consent so as to condone the offence of the accused.
