Bhabhi filed false DV case against my family what can be done
19-Aug-2023 (In Family Law)
My Bhabhi has filed a domestic violence case against my bro and my family. They are demanding for recovery of maintenance amount of 5 lacs and issue warrant against us which is causing a real tension for us. All that she has alleged is incorrect. The warrant is now issued again from 18th aug - 30th aug. We are a middle class family with responsible people who are working and cant manage with these circs. Our lawyers suggests us to leave the place and hide somewhere else, which is not possible. We have called the opp party several times in last week for settlement, but no robust response.
Hi
You don't need to hide or leave your place.
The proceedings under dv act does not require any arrest or detention by police.
You have to face the proceedings on merits.
No need to contact other party. That will make your case weak.

All you have to do is take an anticipatory bail from the sessions court which is filed prior to the arrest of the accused mentioned in the fir! Don't reply to the police file an anticipatory bail asap that will an appropriate action which is to be done!
First appear with your lawyer and get the warrant cancelled. Remain present on every appointed case date so that no warrant is issued. Moreover case dates are given around 1 months distance, so attending it should not be such a huge problem, instead conduct the matter on merits.
Hello,
If a DV case has been filed against you, that means the Magistrate has issued notice against you. I would advise you to appoint a Lawyer and appear before the Court and get all the Warrants cancelled by making an Application for Cancellation of Warrants.
Then I would advise you to file a Revision Application against the order of the Magistrate of issuing process against you all and Challenge the said order.
And the other alternative remedy for you all is to File a Discharge Application in the Magistrate Court on behalf of all Family members challenging the allegations against you and stating that no case is made against you.
