ARE CALL RECORDINGS EVIDENCE AND ARE THEY ENOUGH FOR PROSECUTION?

24-Jun-2023 (In Family Law)
Hi, my in-ways are threatening me to harm me and my family and also for filing fake dowry etc. cases against all of us. nI have bought a new mobile phone with in-built call recorder to record the conversation when next time they threaten me but somebody told me that it will not be admissible as evidence in court because I don't have the consent of that person for recording. So, if I record the call, will that be of any use or I am just wasting my time? I want to file case against them for threatening to physically harm my family. I don't have any evidence till now but I can record call as they threaten me nearly every single day so I can arrange call recording, will that be admissible as evidence in criminal court?

First of all we would advise you to take a precautionary measure by filing An intallah peshbandi application with the concerned police authorities through an advocate. This is a precaution when one has an apprehension of false implication. You may connect for better advise and assistance

Good afternoon

At the outset, I advice you to file an NCR with your nearest police station. Call recordings can be placed in evidence and are considered to be secondary evidence used for corroborate your claims. You must file an NCR and a criminal complaint directly before the magistrate. Please feel free to get in touch in case of further legal assistance.
