Ancestral property transferred to elder brother by undue influence

I have a property dispute with my family. My elder brother influenced my father and transfer much of our ancestors property to his name. Can anything be done with this?

You have a share in your ancestral property so you can file the petition for partition alongwith the application to cancel that document. In addition to this file an application for temperory injunction.

Yes, absolutely you can approach the Civil Court by challenging the said transfer of property,but the details you mentioned is not enough,please do contact me for detail advise i am sure that your right cannot be taken away lightly you have a remedy left.

you may approach to the civil court in the form of suit for declaration, possession, permanent injunction and cancellation of transferred deeds/documents in favour of your brother. to file such suit you need to get the deed/documents you are challenging before the court for cancellation. in case you don't have such documents then file an ROT application before the proper authority.

You will have equal share in the ancestral property i.e. yhe property which was owned by your gand-parents. But in respect of the property self acquired by you father will not br taken as ancestral...
