against domestic violence allegation

sir/ma'm my brother is married for 4 years and have two kids. In 2017 my mother evicted my brother and his wife from property. they don't live with us anymore but my sister in law filed a case against us in mahila court. before she filed a complaint against our family in CAW cell from where she compromised with my brother. i want to know that can court pressurise us to present our brother in court even after eviction from property or any family matter. also what is the counter case we can impose against my sister in law for harassing our family.

Dear client see by debaring her son and daughter inlaw from any property and house your mother can not defend her son against domestic violance case. if the case is lodged court under criminal proceedings can issue warrant at first and even if your son do not appear in court after receiving it court can issue non bailable warrant against the husband of complainant. Your Brother can file Sec 9 case for restitution of his conjugal rights in family court if his wife is not residing with him and left him without any proper genuine reasons.

you stated that your mother evicted the your brother and his wife from the property . now you're sister in-law file a false case against the your family . now you're mother have a legal right to file a civil suit against the your sister in law .

Hello I have perused your query. In this matter Crime Against Women Cell (CAW Cell) sends a failure report to its concerned superiors, if the things are not amicably resolved amongst the woman and her in-laws. Besides, the CAW Cell forwards the Complaint of the woman to the concerned Police Station for registration of a regular FIR. With this recommendation for registration of the FIR in the matter, the role of the CAW Cell comes to an end.

Further, you have an option of filing a criminal complaint of intimidation and can also claim damages in a civil court on the account of mental harassment.
