About staying in the matrimonial house

25-Apr-2023 (In Family Law)
Sir, mine is conjugal rights petition and in I.A- 2, additional affidavit supporting my I.A-2 after his objection and I've requested for staying in my matrimonial house so the respondent has put objection for my I.A-2, objection to my additional affidavit & a memo supporting I.A-2 stating that he'll provide me a alternate accomodation & he has made a rented accommodation fir. but for memo supporting I.A-2 the objection has not filed by my council but my council has requested in I.A-2 & additional affidavit for not to send me out of the matrimonial house. I came to know that my husband want to send me out of the matrimonial house and sell it because the house is in my husband name. So in this my question is can my husband send me out of my petition of conjugal rights and as a legally wedded wife can I tell no for not going to rented accommodation as I've put conjugal rights for our reunion. Now writ petition is going on in high court so can I succeed in staying in the matrimony house

hi. your peteion is for restitution of conjugal rights still pending. no orders are pSsed on interlocutory Application. there is a contradiction in ur statement that u are staying in your matromonial house.. how cum. u have filed for restitution of conjugal rights now the suit becomes infactious.i cannot understand why writ petetion. you can succeed in restitution of conjugal rights and also file permanent injunction suit.
