HiThanks for your help.I am married with 13 yr old. I am 45 yrs old, wife 38. I have 25+ yrs experience in IT. I lost my job during covid, now doing IT freelance from home. Post my job loss, my wife started to work to cover financially, but it turned into disaster. She moved to her parents house in same city, not coming home, not coming to even meet our daughter, even when she was hospitalized twice during covid and once critically on dengue. Now she says she is happy in her parents house, independent and dont want to get into marriage. Not coming to meet doctor or marriage counsellor. I want her back, not divorce, if not for me for the kid. Is it possible for her to get divorce on any ground without my consent?
It looks like your wife has deserted you and daughter and it is unfortunate that she prefers her parents' place over her own family. Your option is to send legal notice through a lawyer asking her to join you. The outcome may be either she will join you or she may file for divorce or do nothing. Even if you may win the restitution of conjugal rights it cannot force your wife to join you. The best option will be to lead a peaceful life with your daughter for her future or go for divorce.

If you wish to reconcile with your wife, you have to file a RCR case on a competent court. On considering your 13yr old kid's moral need as a mother, you might get amicably compromised with your wife.
