A third person blackmailing that he will file a case for visitation
31-Dec-2023 (In Family Law)
I am married to a Muslim, it was a Special marriage. We have a three year old daughter.
My ex is blackmailing that he will file a case for visitational rights and claim that my daughter is his for the sake of damaging my name.
Kindly tell me can someone other than my husband can claim my child. My Husband is the Biological Father and His Name Is Only In The Birth Certificate.
Can someone really file a case like this to defame someone?
There's no way a third person can claim for visitation rights. If such person blackmails then you can lodge a police complaint in order to safeguard your child. If there is dispute over paternity then such person can raise this issue before appropriate court and seek for declaration as to paternity. But he must prove the facts and circumstances based on which he claims paternity.
