125 CrPC maintenance case going on in patna family court

after marriage of 15 year and ex-parte divorce of 5 year ex wife file maintenance case in Patna family court. 13 year old son in her custody. She is well qualified and earning but in court showing the she is jobless. Already paying Rs.15K per month.

If decree of divorce she has got there is no provision of maintenance if she has been getting marriage...in this regard u may be file gardianshhp act to adop the child.tell me entire fact in details that.

Had you appeared the case going on before the Patna Court? If not, then appear. You are paying Rs. 15,000/- under your own or under court's order? If under own, then appear in the case state all the facts.

Since, she is not your wife now as you already secured ex-party divorce from your wife, so she is not entirled to any kind of maintainance from you. That too you already paying Rs. 15k as alimoney to her. You should contest the case on the ground of maintainability of the maintainance petition.
