Quashing DVSuit under section 482


22-Jul-2023 (In Domestic Violence Law)
I got Protection Order & Resident Order under DV Act. I have applied for breach of order to the Hon'ble Court. Court asked Protection Officer for her report. Protection Officer reported that it is breach of order under section 31. Respondent then applied for quashing in the Hon'ble High Court under section 482. Can he quash under section 482 ? Please advice.

hi in this case he has right to file proceedings under 482 of cr p c against application filed by you under dv act now it depends on at which stage he has filed the application. there's very less chance of he getting succeeded because already orders have been passed by the jmfc

There is specific provision under CrPC regarding quashing process. But High Court will not pass order by listening one side. Once you receive notice from High Court, you should keep your case that inspite of protection orders passed by trial court he is not obeying the said order.
