My wife filed for dv & 498a against me & my father. I've been to jc for 4 days & my father is on Acb. This happened after I had sent notice for divorce as she fabricated evidence and now she doesn't want to go for divorce but with the turn of events, I do not wish to stay in this marriage & want a divorce. What's the best course of action to follow. In dv case, we were sent for settlement but it was ruled out as not settled. We are hindu by religion.
Hello, in your case you have to proceed with the trial of 498A by filing your discharge application if the charge is not framed. you have to immediately file divorce petition against your wife for mental cruelty. your wife may file maintenance petition against you which may be difficult to be faced. before she proceed you have to file your divorce petition. there are many other alternate remedies to resolve these cases which depends on the stages of your case.
