Can a complaint case be filed based on difference in complaint of 498a and pwdva case ... different complaint of same time period different allegations different incidence not matching
Yes, there is no bar in filing the complaint but in my legal opinion it won't stand on firm foot and there are high chances of it being rejected.
However, to make your complaint strong enough to be accepted we have to derive points from original complaints.

Yes, of course. A private complaint case can be filed apart from the 498A case and the DV case being pending, provided the nature of allegations and offences made out are different in nature with proper reasoning as to why they were not mentioned in the complaint from which 498A and DV cases emerged out of.
